Welcome to RISE (the Website) at www.channelrise.com.au. The Website and related products and services are operated by Mimi Enterprises as trustee for M.C & E.S Trust (ABN 45 834 994 769) trading as RISE (we, us, our). These Terms and Conditions (Terms) govern your access to and use of the Website and any purchase of products through it. By using the Website or placing an order, you agree to these Terms. If you do not agree, do not use the Website.
1. About RISE
RISE is a beauty brand committed to empowerment, inclusivity and authenticity, offering products that enhance natural beauty without harm to users or the environment.
Registered trade marks (Australia): RISE, CHANNEL RISE, and THE BEAUTY YOU WAKE UP WITH are registered trade marks in Australia owned by Mimi Enterprises as trustee for M.C & E.S Trust.
2. Eligibility & Account Information
2.1 Age: If you are under 18, you confirm you have permission from a parent or legal guardian to place an order.
2.2 Accuracy: You agree that information you provide (including shipping and contact details) is true, accurate and complete.
3. Products & Information
3.1 Product descriptions: We take reasonable care to display product information accurately. However, colours and appearance may vary due to device settings and lighting.
3.2 Ingredients & use: Ingredients and directions are available on product pages and/or packaging. You are responsible for reviewing ingredient lists for allergies or sensitivities before use.
3.3 Skin sensitivity: Always patch test first. Discontinue use if irritation occurs. If symptoms persist, seek medical advice.
3.4 No medical claims: Our products are cosmetic in nature and are not intended to diagnose, treat, cure or prevent any medical condition.
4. Orders, Acceptance & Cancellations
4.1 Order acceptance: Orders are offers to purchase. We may accept or reject an order (including after payment) for reasons such as stock availability, suspected fraud, pricing errors, or compliance requirements. If we cancel, we will refund amounts paid for the cancelled order.
4.2 Cancellations by you: You may request cancellation within 2 hours of purchase by emailing orders@channelrise.com.au. If the order has already been processed or shipped, we may be unable to cancel.
4.3 Limits & discretion: We may limit quantities per order/customer and refuse service where permitted by law.
5. Pricing & Payments
5.1 Currency & GST: Prices are in AUD and include GST where applicable.
5.2 Price changes: Prices and promotions may change at any time. Changes won't affect orders already accepted.
5.3 Errors: If a pricing or description error occurs, we may cancel or adjust the order and will contact you where required.
5.4 Payment methods: We accept credit/debit cards, PayPal and other payment methods displayed at checkout.
5.5 Chargebacks/fraud: Unauthorised or fraudulent chargebacks may result in account restrictions and recovery action.
6. Shipping & Delivery (Australia)
6.1 Shipping area: We currently ship within Australia only.
6.2 Fees & promotions: Shipping fees are shown at checkout. Free shipping (if offered) may be subject to minimum spend, locations and promotional terms, and may be withdrawn at any time.
6.3 Delivery times: Delivery estimates are provided as a guide only and are not guaranteed. Delays may occur due to carrier disruptions or events outside our reasonable control.
6.4 Address responsibility: You are responsible for providing a correct delivery address. Additional costs caused by incorrect or incomplete addresses (including re-delivery/return-to-sender fees) may be charged to you.
6.5 Risk and title: Title in the goods passes to you once we receive full payment. Risk of loss passes upon delivery to the address supplied (or as otherwise required by law). If you request authority to leave, delivery is taken to occur when the carrier leaves the parcel at the nominated address.
7. Returns, Refunds & Australian Consumer Law
7.1 Change of mind: We do not offer returns or refunds for change of mind (including dissatisfaction due to individual results or preferences), except where required under Australian Consumer Law.
7.2 Hygiene/safety: For hygiene and safety reasons, we may refuse returns of opened/used cosmetics except where the product is faulty, unsafe, not as described, or otherwise required under Australian Consumer Law.
7.3 Damaged, faulty or incorrect items: Please inspect your order on arrival. If an item is defective, damaged, missing, or incorrect, contact us at orders@channelrise.com.au with your order number and supporting photos within 7 days of delivery (or as soon as reasonably possible). We will assess and provide a remedy in line with Australian Consumer Law (repair, replacement, refund, or other remedy depending on the issue). This timeframe is to help us investigate and resolve issues promptly and does not limit your rights under Australian Consumer Law.
7.4 Return process: If we request a return, items must be returned in original packaging where possible. We will provide return instructions.
7.5 Return costs: For faulty/damaged/incorrect items (where confirmed), we will cover reasonable return shipping costs or provide a prepaid label where available.
7.6 Refund timeframe: Approved refunds are processed to the original payment method. Processing times vary by payment provider and may take up to 14 business days after approval.
7.7 Australian Consumer Law: Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
8. Intellectual Property
All trade marks, brand names, product designs, text, graphics, logos, images, and other content on this Website are owned by or licensed to Mimi Enterprises as trustee for MC & ES Trust and are protected under Australian intellectual property laws.

You must not use our trade marks (including in metatags, advertising keywords, social media handles, marketplace listings, or business names) without our prior written consent.
You must not copy, reproduce, distribute, display, modify, or create derivative works from any Website content without our prior written permission.
9. User Content (Reviews, Comments, Tags)
If you post or submit content (including reviews), you grant us a worldwide, royalty-free, perpetual, irrevocable licence to use, reproduce, modify, publish and display that content for marketing and operational purposes. You warrant you have the rights to submit it and it does not infringe third-party rights or break any law.
10. Prohibited Conduct
You must not misuse the Website, including attempting unauthorised access, interfering with security or functionality, using the Website to transmit unlawful material, or engaging in conduct that is harmful, misleading, or fraudulent.

The Website may include links to third-party sites. We are not responsible for their content, policies, or practices.
12. Privacy
Your use of the Website is also governed by our Privacy Policy.
13. Limitation of Liability
To the maximum extent permitted by law, we exclude all warranties not expressly stated in these Terms. Nothing in these Terms excludes, restricts, or modifies any right or remedy you have under the Australian Consumer Law or other applicable law that cannot be excluded.
To the extent permitted by law, our liability is limited (at our option) to resupplying the goods or paying the cost of having the goods resupplied.

We may update these Terms from time to time by posting the updated version on the Website. The "Last Updated" date indicates when changes were made.
15. Governing Law
These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of NSW.
15.1 Severability: If any part of these Terms is invalid or unenforceable, that part will be read down or severed and the remainder will continue in full force.
15.2 Entire Agreement: These Terms (and any policies referenced in them) constitute the entire agreement between you and us regarding your use of the Website and purchases made through it, and supersede any prior representations or agreements to the extent permitted by law.
